Terms of Service

1. Agreement to Terms

By accessing or using GameTrowel ("the Platform"), operated by GameTrowel ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all users, including visitors, free-tier users, and paid subscribers. We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-platform notice at least 30 days in advance.

2. Eligibility

You must be at least 16 years of age to use the Platform. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Account Registration

To access most features, you must create an account using a valid email address or a supported OAuth provider (e.g., Discord). You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us promptly at support@gametrowel.com if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for an extended period, with prior notice where feasible.

4. Studios and Team Members

Each account can create or belong to one or more studios. The studio owner is responsible for all content published and actions taken by team members within that studio. Inviting team members grants them access to studio resources according to their assigned role (Owner, Admin, or Member).

5. Subscriptions and Billing

GameTrowel offers free and paid subscription tiers (Starter, Pro, Studio). Paid subscriptions are billed monthly or annually via Stripe.

• Billing cycle: Subscriptions renew automatically at the end of each billing period unless cancelled.
• Price changes: We will notify you at least 30 days before any price increase. Continuing your subscription after the effective date constitutes acceptance.
• Upgrades: Take effect immediately. You will be charged a prorated amount for the remainder of your billing period.
• Downgrades: Take effect at the end of the current billing period. Features above your new tier's limits will become read-only.
• Cancellation: You may cancel at any time through the billing settings. Access to paid features continues until the end of the current billing period.
• Refunds: We do not offer refunds for partial billing periods except where required by applicable law. If you believe you were charged in error, contact us within 14 days.

6. Your Content

"Your Content" means any text, images, videos, game assets, press materials, blog posts, email templates, and other materials you upload, create, or publish through the Platform.

• Ownership: You retain all intellectual property rights to Your Content. We do not claim ownership over anything you create.
• License to us: You grant us a limited, non-exclusive, worldwide license to host, display, cache, and distribute Your Content solely for the purpose of operating and providing the Platform's services (e.g., serving your landing pages, sending your emails, displaying your press kits).
• Showcase: If you opt in to the public showcase, we may feature your landing pages as examples of the Platform's capabilities.
• Responsibility: You are solely responsible for Your Content. You represent that you have the rights to all content you upload and that it does not infringe on any third party's intellectual property or other rights.

7. Acceptable Use

You agree not to use the Platform to:

• Publish content that is illegal, defamatory, obscene, or promotes violence or hate speech
• Send unsolicited bulk email (spam) through the outreach or mailing list tools
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload malware, viruses, or any code designed to disrupt or damage the Platform or its users
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or connected systems
• Scrape, crawl, or otherwise extract data from the Platform except through provided APIs
• Use the press contact database for purposes other than legitimate game marketing outreach
• Distribute game keys obtained fraudulently or for unauthorized resale
• Circumvent tier limitations, rate limits, or other usage restrictions

We reserve the right to remove content, suspend accounts, or restrict access for violations of these rules, with notice and opportunity to remedy where feasible.

8. Email Sending and Anti-Spam

The Platform provides email tools for press outreach and mailing list campaigns. You agree to:

• Comply with all applicable email laws including CAN-SPAM, GDPR, and CASL
• Only email contacts who have a legitimate reason to receive your message (existing relationship, public press contact, or confirmed opt-in)
• Honor all unsubscribe requests promptly
• Include accurate sender information and a working unsubscribe mechanism in all emails

First outreach campaigns from new accounts may require review before sending. Abuse of email tools will result in immediate suspension.

9. AI-Generated Content

The Platform uses AI (powered by OpenAI) to generate landing page content, press kit drafts, blog posts, Steam descriptions, social media posts, and outreach pitches.

• AI-generated content is provided as a starting point. You are responsible for reviewing, editing, and approving all content before publishing.
• We do not guarantee the accuracy, originality, or appropriateness of AI-generated content.
• You own the output of AI-generated content to the extent permitted by applicable law, subject to any third-party terms (e.g., OpenAI's usage policies).
• AI features may have usage limits based on your subscription tier.

10. Custom Domains

Pro and Studio tier users may connect custom domains to their landing pages. You represent that you own or have authorization to use any domain you connect. We provision SSL certificates via Let's Encrypt for connected domains. We are not responsible for DNS misconfigurations, domain expiration, or third-party DNS provider issues.

11. Game Keys

You may import and distribute game keys through the Platform. You are solely responsible for the keys you upload and their distribution. We encrypt stored keys at rest but cannot guarantee absolute security. We are not liable for key misuse by recipients after distribution.

12. Press Contact Database

The Platform maintains a database of press contacts for use by eligible subscribers. Contact information is gathered from public sources and verified periodically. You agree to:

• Use contact data only for legitimate game marketing outreach
• Not export, scrape, or redistribute the contact database
• Respect opt-out preferences of contacts who request removal

We do not guarantee the accuracy or completeness of contact information and are not responsible for delivery failures or negative responses.

13. Third-Party Integrations

The Platform integrates with third-party services including Discord, Steam, Stripe, social media platforms, and others. Your use of these integrations is subject to the respective third-party's terms of service. We are not responsible for the availability, accuracy, or actions of third-party services.

14. Intellectual Property

The Platform, including its design, code, templates, branding, and documentation, is owned by GameTrowel and protected by applicable intellectual property laws. Landing page templates are licensed for your use through the Platform only and may not be extracted or redistributed.

15. Limitation of Liability

To the maximum extent permitted by applicable law, GameTrowel and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of or inability to use the Platform.

Our total aggregate liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

16. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

17. Indemnification

You agree to indemnify and hold harmless GameTrowel and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third party's rights.

18. Termination

You may delete your account at any time through account settings. We may suspend or terminate your access if you violate these Terms, with notice where feasible.

Upon termination, your published landing pages and press kits will be taken offline. You may request an export of Your Content within 30 days of termination by contacting us. After 30 days, we may permanently delete Your Content.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
